"Justice Priestley's paper asserts that the constitutional role and the independence of New Zealand's judicial arm of government is little appreciated and widely misunderstood. Since it is the judicial arm which underpins personal rights and freedoms in a democracy, the judicial arm needs champions. The paper examines the historical development of an independent judiciary; looks at historic and contemporary tensions which arise between the judiciary and the other two arms of government; and examines recent developments involving the judiciary in New Zealand, pointing to some of the risks which might emerge if the judicial arm is weakened."
Justice J Priestley was appointed to the High Court Bench in 2000. Since his appointment Justice Priestley has at various times been the List/Executive Judge in the High Courts at Hamilton, Rotorua, New Plymouth, Whangarei and Gisborne. He is currently the High Court representative on the Judicial Libraries Management Board. He is based in the Auckland High Court.
